The lawsuit claims that Oracle unlawfully paid women in certain job codes less than men for performing substantially similar work in violation of California’s Equal Pay Act, Cal. Labor Code § 1197.5 (“California EPA”) and California’s Unfair Competition Law, Cal. Bus. & Prof. Code section 17200, et seq. (“UCL”) (together, the “Equal Pay Act Claim”). The lawsuit also claims that Oracle allegedly had a practice of relying on the prior pay of job candidates to determine starting pay, and this practice had an unlawful disparate impact on the pay of women in certain job codes in violation of the UCL (the “Disparate Impact Claim”).

Oracle denies the allegations in the lawsuit and maintains that it has fully complied with all applicable laws, rules and regulations at all times. The Court has not ruled on the merits of these claims, has made no findings of fault, and has not awarded damages. The Settlement is a compromise of alleged claims and is not an admission of liability on the part of Oracle or anyone else. The parties have reached this Settlement in order to avoid the costs and uncertainty associated with further protracted litigation.

The proposed class consists of employees of Oracle at some point between June 16, 2013 and date of preliminary approval, who identified as female and who worked in California in Oracle’s Product Development, Information Technology, or Support job functions, other than campus hires and managers. If you spent time working in one or more of those job functions in California since June 2013 then you are covered by this lawsuit (the “Covered Positions”).

The Court in charge of the case is the San Mateo Superior Court, and the case is known as Jewett v. Oracle America, Inc. 17-CIV-02669 (the “Action”). The individuals who sued are called the Plaintiffs and the entity they sued, Oracle, is called the Defendant.

The Motion for Preliminary Approval has been filed and is pending Preliminary Approval.
